1. Business Identity & Brokerage Disclosure

ClearStart Properties is affiliated with Keller Williams Elite. Each office is independently owned and operated. Use of this website does not create a broker-client, agency, fiduciary, or contractual relationship unless and until a separate written agreement is executed.

2. Eligibility

The Services are intended for individuals 18 years of age or older who are seeking real estate information for personal, non-commercial use.

3. Permitted Use

You may use the Services solely for your personal, non-commercial real estate purposes, such as viewing listings, requesting information, or submitting inquiries.

You agree not to:

  • Scrape, harvest, index, data-mine, copy, mirror, frame, or reproduce any portion of the Services

  • Use automated means (bots, crawlers, scripts) to access the Services

  • Redistribute, resell, sublicense, or commercially exploit any listing data

  • Circumvent security or access controls

  • Use the Services for unlawful, misleading, or fraudulent purposes

We reserve the right to restrict or terminate access at any time without notice.

4. IDX / MLS Property Information

Property listings and related data are provided for personal, non-commercial use only.

Listing information is deemed reliable but not guaranteed. Data may be inaccurate, incomplete, delayed, or withdrawn without notice.

All listing data is protected by copyright and owned by the applicable Multiple Listing Service, including MLS Property Information Network, Inc. (MLS PIN). Unauthorized reproduction or redistribution is strictly prohibited.

5. No Reliance; Informational Purposes Only

All content on the Services is provided for general informational purposes only and does not constitute legal, financial, tax, or real-estate advice.

You should independently verify all information and consult appropriate professionals before making decisions.

6. No Guarantee of Representation or Results

Submitting a form, requesting information, receiving communications, or viewing listings does not obligate us to represent you, nor does it guarantee availability, pricing, suitability, or transaction outcomes.

7. User Submissions & Communications

By submitting information through forms (including contact requests, home valuation tools, newsletters, or inquiries), you:

  • Represent that the information is accurate and submitted by you

  • Consent to being contacted by us via email, phone, or text (where applicable)

  • Acknowledge communications may include automated or CRM-based messages

You may opt out of marketing communications at any time.

8. Third-Party Services

The Services may integrate or link to third-party tools and platforms, including but not limited to:

  • IDX providers

  • Customer relationship management systems

  • Google Maps or Bing Maps

  • Analytics and marketing platforms

We do not control third-party services and are not responsible for their content, availability, or policies. Your use of third-party services is governed by their respective terms.

WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF ACCURACY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Services will be uninterrupted, error-free, secure, or current.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, PROFITS, OR BUSINESS OPPORTUNITIES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM YOUR USE OF THE SERVICES SHALL NOT EXCEED $100.

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law principles. Any disputes shall be resolved exclusively in Massachusetts state or federal courts.

17. Severability

If any provision is found unenforceable, the remaining provisions will remain in full force and effect.
